How dare you oppose God’s war ?

Ehren Watada, lieutenant of the USA army refuses to participate in Iraq war. Is he an evil man ? :)
It seems that he will be condemned anyway since :
“the judge hearing the case has already said that the issue of the legality of the war in Iraq will not be raised during the court martial, saying the proceeding has no authority to rule on the question.”
I wonder how he is gonna defend if his point was that sending him to war in Iraq was an illegal order, and therefore, he didn’t have to obey it (according to the US constitution, I think he even has to refuse).
